TENANT T&C
(1). No Cost (FREE) Tenant Prequalification Questionnaire: All prospective tenants are required to complete a Tenant's Prequalification Questionnaire before seeing any of our properties. The point of such questionnaires is to qualify the tenant and not waste anyone's time, energy, or money. If the information received on a tenant's formal application is different from what the tenant has provided on the pre-qualification questionnaire, this may affect the tenant's pre-qualification status. For the most accurate qualification we recommend that all adults in the household and co-signing complete the questionnaire, as all adults and cosigners will need to apply when completing the formal application for the property. It is the tenant's responsibility to ensure that all information provided is accurate to the best of their ability. ​
(2). Formal Applications: Formal applications are $75 per adult in the household and co-signing. Our application fees for our formal applications are non-refundable, which is why it is important to pre-qualify for free using the pre-qualification questionnaire before formally applying with us. The application fee covers the costs associated with 3rd party processing of any available credit reports, eviction/legal proceeding reports, criminal history reports, income verification, and the internal processing of the tenant application, reports, and supporting documents. It is the tenant's responsibility to ensure that all information provided is accurate to the best of their ability. If the tenant would like a copy of their formal application and any available reports, email requests for copies to Broker@LocalPMC.com cc on all correspondence Eric@LocalPMC.com.​
(3). Fraudulent Chargebacks: If a prospective tenant conducts a fraudulent chargeback, such prospective tenant will not be considered at any of our other properties until such prior money owed has been returned to our office alongside any additional fees incurred as a direct result of the chargeback.
(4). ​No Holds or Guarantees: Elite Class Property Management & Real Estate Company and its associates cannot hold or guarantee any property until an application has been completed, approved, lease has been executed, and move-in deposits/conditions have successfully been completed. If someone applies formally -before another prospective tenant- the first completed application will be processed. Applications are processed on a first come first serve basis. ​
(5). Equal Housing Opportunity: Our properties provide an equal housing opportunity.​
(6). Negotiating Lease Terms: If a tenant desires to negotiate lease terms with a property's landlord, the tenant must initiate negotiations before executing the lease.
(7). Errors on MLS or Rental Listings: If any error is identified in the MLS or rental listing, it must be brought to the attention of our office prior to lease execution. Notification after a lease has been executed does not entitle any party to concessions or adjustments. Errors may occur, and upon discovery, we will make reasonable efforts to clarify and correct them. While we strive to ensure all information is accurate, we cannot guarantee perfection. For this reason, the executed Lease Agreement shall be the final and binding agreement between the parties.
(8). High-risk Applications: For high-risk applications a larger deposit, co-signer, or both may be required as a condition for application and/or lease approval.​
(9). Agency Relationship: Elite Class Property Management & Real Estate Company usually operates as a Single Agent exclusively representing the landlord. However, in certain circumstances, Elite Class Property Management & Real Estate Company may transition from a Single Agent to a Transaction Broker to help facilitate a transaction. In these transactions, Elite Class Property Management & Real Estate Company does not represent anyone. Please note that Dual Agency is strictly prohibited in the state of Florida. OUR PROPERTIES & LISTINGS​
(1). ​Measurements: Measurements of any property listed with Elite Class Property Management & Real Estate Company may not be exact; tenants must conduct their own due diligence on their own time and at their sole expense.​

(2). ​Property Details: The Property's details, rents, deposits, fees, and move-in funds are subject to change without prior notice. (3). ​Accuracy of Information: Elite Class Property Management & Real Estate Company strives to provide accurate and reliable information; however, human error may occasionally occur from time-to-time. In the event of any discrepancy in the information provided by our office, we will promptly address and clarify the matter upon becoming aware of the error.​ For this reason, the executed Lease Agreement shall be the final and binding agreement between the parties.
(4). ​Properties are Rented on an As-Is Basis: Our rental properties are leased as-is, meaning tenants accept the property in its current state at the time of signing. All properties meet habitability standards, but optional improvements or repairs may not be provided unless formally agreed upon. We recommend tenants inspect the property and discuss any concerns before submitting an application. (5). ​Homes Built Before 1978; Lead Based Paint: For properties built before 1978, there is a potential for the presence of lead-based paint. Tenants will be provided with a Lead-Based Paint Disclosure form and EPA Information Pamphlet, and it is recommended that they review this document carefully before signing the lease.​

COOPERATING BROKERS​ T&C
This subsection only applies to rental listings listed by Elite Class Property Management and Real Estate Company or its agents, and only where a commission or referral fee is offered. ​
​
Elite Class Property Management and Real Estate Company may, at its sole discretion, cooperate with other licensed real estate professionals, when doing so is in the best interest of our client or customer. We reserve the right to refuse service.

By cooperating with Elite Class Property Management and Real Estate Company on any of its rental listings, cooperating brokerages agree to the following payment methods, terms, and conditions:

(1). Commission and Referral Fee Contingencies: All commission(s) and or referral fee(s) offered by Elite Class Property Management and Real Estate Company and its agents are contingent upon the successful completion of the following:

Successful application and document submission by all adults in tenant's household

Full execution of the lease by all parties to the lease (e.g., all adult tenants, landlord[s], and landlord's agent/property manager)

Receipt and clearance of all required tenant move-in funds
-
Completion of all tenant pre-move-in conditions, including but not limited to establishing all required utilities and services, obtaining a renter’s insurance policy listing the landlord(s) as additionally insured, and fulfilling any other requirements outlined in the lease agreement.

(2). Difference between Referrals and Commissions: Eligibility for any commission and or referral fee is contingent upon the cooperating brokerage’s role and level of participation in the transaction, as disclosed in these terms. A referral fee applies where the cooperating brokerage introduces a prospective tenant and does not actively participate in the transaction as the tenant’s representative. A commission applies where the cooperating brokerage acts as the tenant’s agent and performs the customary duties associated with such representation throughout the transaction. The type of compensation offered shall be based on the cooperating brokerage’s actual role and participation in the transaction, consistent with these terms and the services performed.

(a). Referrals: A cooperating brokerage will be considered a referral if they introduce a tenant to our firm but do not actively participate in the transaction as the tenant’s agent. In such cases, Elite Class Property Management and Real Estate Company will handle the transaction in its entirety. Referral fees, if offered, will be paid upon successful completion of the transaction in accordance with the contingency requirements and terms and conditions set forth herein. (b). Commission Expectations (Tenant Representation): A cooperating brokerage will be eligible for a commission only if they actively represent the tenant throughout the entire transaction and fulfill the following responsibilities:

Act as the tenant’s agent

Show the property to the tenant

Relay any concerns of safety or habitability matters to our office immediately on behalf of your client

Assist the tenant with the application process, if necessary
-
Ensure submission of all required documentation
-
Assist the tenant in meeting all lease requirements and deadlines
-
Guide the tenant in setting up required utilities and services
-
Assist the tenant with instructions for submitting move-in funds or assist them in communicating with our office
-
Maintain communication with our office and the tenant to ensure the tenant progresses through all required steps
-
(Optional, but suggested) Conduct a walkthrough with the tenant prior to lease effective date​
If the cooperating brokerage does not perform these aforementioned responsibilities, or requests that our firm perform core functions, the transaction may be reclassified as a referral at our discretion.​

(3). Payments: Elite Class Property Management and Real Estate Company exclusively utilizes electronic payment methods for all rental listing commission and or referral fee disbursements. By cooperating with us on any rental listing, cooperating brokerages represent and agree that they are able to accept payment via electronic check (“e-check”) delivered via email. All electronic payments are processed through Checkbook.io and are sent to the cooperating brokerage’s designated email address, along with instructions for deposit accessible via secure hyperlink. Payment options include direct deposit or print-and-deposit. We strongly recommend direct deposit, as it allows for streamlined and automated future payments once established. Upon completion of a transaction, the cooperating broker is required to provide a copy of their brokerage’s most current executed W-9 form, along with payment information, including the brokerage’s legal “pay to” name, email address, mailing address, and phone number. Disbursement of commissions or referral fees will occur within 30 business days from the lease effective date and upon satisfaction of all of the following conditions:

(4). Lease Negotiations: Our firm utilizes customized lease agreements and forms that are not owned, managed, maintained, or standardized by any Realtor association. Accordingly, lease terms and negotiations are conducted directly between the landlord and the tenant. During the transaction, our firm serves as the communication conduit between the landlord and the tenant and acts on behalf of the landlord. The tenant is responsible for reviewing their lease agreement and may, at their sole discretion and expense, seek independent legal counsel for review if they choose. If the tenant has general (non-legal) questions regarding the lease agreement or tenancy, cooperating brokers are encouraged to direct such communications to our office for coordination and clarification.
